Rightsholders can report that infringing material is available via EnsembleHub. Below you can read how to submit a notice and how we handle it.
EnsembleHub is a rehearsal-prep tool. Organizers themselves attach material to a rehearsal, visible only to the members they invite into their private ensemble. We do not provide sheet music or repertoire ourselves, are not a sheet music library, and do not select, edit, or monitor uploaded material. Responsibility for the material and the rights in it rests with the user who provides it; they confirm with every upload that they hold the rights.
If you are a rightsholder, or represent a rightsholder or collective management organization, and believe that specific material available via EnsembleHub infringes your copyright or related rights, you can report it to us. You can report other illegal material the same way.
Send your notice to copyright@ensemblehub.nl and include: (1) why you believe the material is illegal, with a substantiation of your right; (2) where it is, as precisely as possible. Because everything sits behind a login, you usually will not see a link: name the ensemble, the rehearsal, the title of the work, and if possible the file name; (3) your name and email address; (4) a statement that you believe in good faith that the information in your notice is accurate and complete.
We send you an acknowledgement with a reference number. A person reviews the notice carefully and without undue delay; we do not use automated means for this. If the notice is sufficiently substantiated, we promptly remove the material, including where it appears in several rehearsals. The user who uploaded it receives a statement of reasons and can object. You are told our decision and how you can challenge it.
Both the notifier and the user can object to our decision by replying to our email or writing to copyright@ensemblehub.nl with the reference. A person reviews the objection again. If the material turns out to be lawful after all, for example because the ensemble holds a licence, we restore it and tell both parties. Anyone can also go to court.
We use your name, email address, and notice only to handle the notice and to record what we decided. We share your identity with the user concerned only where strictly necessary. We keep the file for up to five years after our decision, because a claim about an infringement can run that long (Article 3:310 of the Dutch Civil Code); after that we delete it.
A notice must be submitted in good faith. Knowingly false or misleading notices may expose the person submitting them to liability. Where we have doubts about the basis of a notice, we may ask for further substantiation.
